ToTu is an application which connects customers to businesses. In addition, you understand and agree that the Service is provided on an AS IS and AS AVAILABLE basis. ToTu Limited disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. ToTu Limited also reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you.

3. Content of the Service.

ToTu Limited takes no responsibility for third party content (including, without limitation, any viruses or other disabling features), nor does ToTu Limited have any obligation to monitor such third party content. ToTu Limited reserves the right at all times to remove or refuse to distribute any content on the Service, such as content which violates the terms of this Agreement. ToTu Limited also reserves the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (a) satisfy any applicable law, regulation, legal process or governmental request, (b) enforce this Agreement, including investigation of potential violations hereof, (c) detect, prevent, or otherwise address fraud, security or technical issues (including, without limitation, the filtering of spam), (d) respond to user support requests, or (e) protect the rights, property or safety of ToTu Limited, its users and the public. ToTu Limited will not be responsible or liable for the exercise or non- exercise of its rights under this Agreement.

4. Exclusions of ToTu’s liability.

The information contained in the material in this web site is only for information purposes. ToTu is not liable for any action you may take as a result of relying on any information provided in this Site. Under no circumstance will ToTu Limited be liable for any of the following loses or damages (whether such loses where foreseen, foreseeable, known or otherwise): lose of data, lose of revenue or anticipated profits, loss of sales, lose of business, lose of opportunity, lose of goodwill or injury to reputation, loss of any software or data, loses suffered by third parties, or any indirect consequential, special or exemplary damages arising from the use of ToTu.co.uk regardless of the form of action. You agree that the obtaining of any material through the use of the Service is carried out at your own risk and that ToTu has no liability to you in respect of such material or the effects of such material. ToTu tries to make sure that all information contained on the Site is correct, but it does not accept any liability for any error or omission. The Site includes links to external sites and co-branded pages. ToTu has included links to these sites and co-branded pages to provide you with access to information and services that you may find useful or interesting. ToTu is not responsible for the content of these site and pages or for anything provided by them. The ToTu website collects feedback on businesses; these can be viewed by any user. Any registered user who has used any service provided by businesses listed on ToTu website can leave a feedback by rating the business’ quality of service and/or by posting a comment. Although this is helpful it is not a fail-safe way of knowing whether a business is the right choice for you. ToTu Limited takes no responsibility for anything whatsoever that may happen after it has connected a customer with a business. It should also be noted that we are not in control of when customers will telephone you. ToTu disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Site. 5. Intellectual Property Rights.

ToTu Limited's Intellectual Property Rights. You acknowledge that ToTu Limited owns all right, title, images, trade marks, logo and interest in and to the Service, including without limitation all intellectual property rights (the "ToTu Limited Rights"), and such ToTu Limited Rights are protected by U.K. and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service. The ToTu Limited Rights include rights to (a) the Service developed and provided by ToTu Limited; and (b) all software associated with the Service. ToTu Limited Rights do not include third-party content used as part of Service, including the content of maps appearing on the Service. The reproduction, copying, downloading, storage, recording, broadcasting, retransmission and distribution of any part of the ToTu.co.uk website is not permitted without prior written consent of ToTu.co.uk.

6. Your Intellectual Property Rights.

ToTu Limited does not claim any ownership in any of the content, including any text, data, information, images, photographs, music, sound, video, or other material, that you upload, transmit or store in your ToTu account (business card). You state and warrant that all of the information provided by you to ToTu to participate in the Services is correct and current; and you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.

7. Privacy.

As a condition to using the Service, you agree to the terms of the ToTu Privacy Policy as it may be updated from time to time. ToTu understands that privacy is important to you. You do, however, agree that ToTu may monitor, edit or disclose your personal information, including the content of your emails, if required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute, or court order), or as otherwise provided in these Terms and Conditions and the ToTu Privacy Policy. Usage of your personal information is managed by ToTu's Privacy Policy, which forms part of these Terms and Conditions. In the event that ToTu undergoes reorganization or is sold to a third party, you agree that any personal information ToTu holds about you may be transferred to that reorganized entity or third party.

8. What you are not allowed to do:
1. You are not allowed to make any copies of any part of the Site.
2. You are not allowed to use automated scripts to collect information from or otherwise interact with the Service or the Site.
3. You are not allowed to use the Service or the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site.
4. You are not allowed remove or change anything on the Site.
5. You may not print more than 10 copies of any maps or other materials from the Site.
6. You are not allowed to copy or use any material from the Site for any commercial purpose.
7. You are not allowed to capture any map images, map data or lat/lon information from the Site.
8. You are not allowed to remove or change any copyright, trademark or other intellectual property right notices contained in the original material or from any material copied or printed off from the Site.
9. You must only use the Site and anything available from the Site for lawful purposes, and you must comply with all applicable laws, statutes and regulations. You must not use the Service to:
   • Upload, post, transmit or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, pornographic, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable.
   • upload files that contain software or other materials in breach of any intellectual property rights or in breach of confidence;
   • download any file or materials posted by another user that you know, or reasonably should know cannot be copied or otherwise used;
   • intimidate, harass, stalk, threaten or otherwise violate the rights of others;
   • harm or threaten to cause harm to minors;
   • impersonate any person or entity, or falsely state or otherwise misrepresent your identity or status;
   • register for more than one User account, register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity
   • Use or attempt to use another's account, service or system without authorization from the Company, or create a false identity on the Service or the Site
   • hack into the Site or any other related computer system, make excessive traffic demands, deliver viruses or any other computer code designed to interrupt or limit the functionality of any computer software or hardware or telecommunication equipment; or forward chain letters, surveys, contests, pyramid schemes or otherwise engage in any other behaviour that may reasonably be expected to inhibit other users from using and enjoying the Site or any other web site or damage or destroy the reputation of ToTu or any third party;
   • harvest or collect email addresses or other contact information of other users from the Service or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.
10. ToTu reserves the right to block your access and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions or any breach of applicable law or regulation. ToTu will also in its absolute discretion fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security.
9. Suspension and termination of Service
• ToTu may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Site from time to time. Access to or use of the Site or any Sites or pages linked to it will be not necessarily be uninterrupted or error free.
• ToTu may terminate the Service immediately in the event you breach any of these terms and conditions.
• You may cancel your use of the Services and/or terminate this Agreement with or without cause at any time by providing written notice to ToTu online; provided, however, that a terminated account may continue to exist for up to two business days before such cancellation takes effect.

11. General and governing law
1. ToTu may change these terms and conditions from time to time and will endeavour to notify you of any major changes by posting a message on the Site. By browsing the Site you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the Site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter. If any provision of these terms and conditions is found to be unenforceable, this shall not affect the validity of any other provision. ToTu may delay enforcing its rights under these terms and conditions without losing them. You agree that ToTu may sub-contract the performance of any of its obligations or may assign these terms and conditions or any of its rights or obligations without giving you notice.
2. ToTu will not be liable to you for any breach of these terms and conditions which arises because of any circumstances which ToTu cannot reasonably be expected to control.
3. These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.
